Medical compensation lately touching 12 crore, Capping the Compensation is a must to ensure the Health of Health Care Delivery in India

The Supreme Court on Thursday directed Kolkata’s AMRI Hospital and three of its doctors to pay an amount of Rs 5.96 crore as compensation to Saha.
Saha will get a total of Rs 11.41 crore as the court ordered that he was entitled to six per cent interest on the compensation amount from 1999.
So what should be the limit of the compensation amount?
It is obvious that Judges are using a formula used in accident victims to calculate compensation. Lawmakers in our country will take decades to understand these issues. Sympathy will always be with the sufferer.
This news piece brings the following thread for discussion in this august group.
1. Time has come to Treat PATIENTS in a fully Legal manner, without Considering the Costs and Logistics involved. ( caution IRMS) no half hearted attempt.
2. However cordial the doctor patient relationship may be,when a patient dies the situation is hijacked by a third party, the emotional bystanders, TU with vested interest, lawyers with personal gains leading to complication.
3. should IRMS have an signed written agreement with the beneficiary with information to the authorities (& Judiciary ) about its constraints & difficulties arising to the beneficiary in health care delivery especially in emergency cases. We do engage inappropriately qualified members to treat speciality patients at odd hours. There efficiency is questionable at any legal forum.
3. Whether our Hospitals need to have a Legal contract signed along with consent stating that Compensation awarded by court in case of an adverse result shall not exceed a ceiling.
Paranoia pervades today’s healers’ consultation.
“1. Treating patient as your enemy sitting across the table.
2. Always trying to make him understand the worst possible outcome of the disease.
3. Still you feel uncomfortable at times when they don’t want to understand rather do not accept the outcome.
4. Now it is time to make a habit to record every details on opd slips.
5. That may not be able to save you in case of any unwanted outcome in your patient
